Terms of use

1.1These terms apply to anyone who uses this website, which is published by Helm Toss, a made-to-measure lingerie atelier at 2-2-11 Oomorimachionakajima, Yokote, Akita 013-0514, Japan.
1.2By browsing the site you accept them. They are written to be read, not skimmed past, so each clause says one thing.

2.1The site introduces the atelier, explains how a commission works and publishes articles about fit and fabric. It is not an online shop. You cannot order, pay or check out here.
2.2Every piece Helm Toss makes is made to order after a conversation by email, form, telephone or video. The page you are reading does not form a contract on its own.

3.0

3.1The text, the drawings and the page design are the work of Helm Toss. You may quote a short passage with a link back to the page it came from.
3.2Reusing our material commercially, or copying whole articles elsewhere, needs our written permission. Ask first at info@helm-toss.com.
3.3Where a photograph or text is credited to someone else, it stays theirs and is used with their permission or under the licence stated by its source.

4.1The articles on fit, fabric and measuring are general information drawn from the way we work. They are not medical advice and they are not a promise that a particular style will suit your body.
4.2If you have a medical condition, are recovering from surgery or use a prosthesis, speak to your own health professional about what is comfortable to wear. We can draft a pattern around your measurements, but we cannot judge your health.

5.1We try to keep the pages correct, but descriptions of styles, fabrics and processes may change before a page is updated.
5.2The site does not display prices. A price is quoted for your commission in writing, in Japanese yen with consumption tax shown, and only that quote is binding.

6.0

6.1Before any fabric is cut, we send you a written summary of the piece, the measurements it is based on, the price, any deposit, the date the balance is due, the expected schedule and the adjustment round that is included. The commission starts when you confirm it in writing.
6.2We may decline a commission, for example when a piece cannot be made well from the measurements supplied or when the schedule cannot be met. If we decline, nothing is owed.
6.3A made-to-measure piece depends on the measurements you give us. Please take them as the guide describes and tell us if something looks uncertain. If a measurement turns out to be wrong, we will say what correcting it would involve before doing any further work.

7.0

7.1Because each piece is cut to one person's body, it cannot be resold, so a finished piece cannot be returned for a change of mind. This is stated in every commission summary before you confirm.
7.2If a finished piece has a fault of workmanship, or differs from what was agreed in writing, tell us and we will put it right in the way that summary describes. Your rights under Japanese law are not reduced by anything on this page.
7.3Cancelling a commission after cutting has begun may mean paying for the work and materials already used. The summary sets out where that line falls.

8.1Enquiries about lingerie are personal. We treat what you send with care and ask in return for the same courtesy. We may stop replying to messages that are abusive, or that ask for images or services outside garment making.

9.1Where an article links elsewhere, it is for your convenience. We do not control other websites and are not responsible for what they publish or how they treat your data.

10.0

10.1To the extent the law allows, Helm Toss is not liable for indirect or consequential loss arising from use of this website.
10.2We are not responsible for decisions taken only on the strength of the general information published here.
10.3Nothing in these terms excludes liability that cannot be excluded under Japanese law.

11.0

11.1We may revise these terms from time to time. The version on this page, with the date shown at its foot, is the one that applies when you visit.

12.0

12.1These terms are governed by the laws of Japan.
12.2If a disagreement cannot be settled by talking, which is always our first step, the Akita District Court is the court of first instance by agreement, to the extent the law permits.
