Privacy policy

  1. 1.1This page explains how Helm Toss, a small made-to-measure lingerie atelier at 2-2-11 Oomorimachionakajima, Yokote, Akita 013-0514, Japan, handles the personal information it receives through this website, by email and by telephone.
  2. 1.2We handle it in line with Japan's Act on the Protection of Personal Information (APPI). Where this page uses the word data, it means personal information in the sense of that Act.
  3. 1.3This website has no accounts, no online shop and no payment page, so almost everything below concerns the messages you choose to send us and the measurements you choose to share for a commission.
  4. 1.4The person responsible for handling personal data at Helm Toss is named on request. Write to info@helm-toss.com and we will give the name without delay.

What reaches us

  1. 2.1When you use the contact form, write to info@helm-toss.com or call, we receive your name, your email address, an optional telephone number and the text of your message.
  2. 2.2For a commission you may also send body measurements, photographs of garments that no longer fit, fabric preferences and a delivery address. Please send only what the pattern needs. If something is not needed, we say so and delete it.
  3. 2.3If you mention surgery, a medical condition or a prosthesis so that a pattern can be planned around it, we treat that as sensitive information requiring special care under the APPI. We ask for it only when you offer it, use it only to plan your pattern and never pass it on.
  4. 2.4The company that hosts this website may keep ordinary technical logs, such as the address of the visiting device, the time and the page requested. We do not use those logs to identify visitors.
  5. 2.5We never need card numbers, bank passwords or identity documents by email or through the form. Please do not send them.

Why we use your data

  1. 3.1We use your data to reply to your message, to explain what a commission would involve, to prepare a quote and a schedule, and to arrange a video call, a visit to the atelier or a shipment.
  2. 3.2Once a commission is agreed, we use your measurements to draft and adjust your own patterns, and we keep a record of what was agreed so that both sides can check it later.
  3. 3.3We also use data where the law requires it, for example for bookkeeping and tax records.
  4. 3.4We do not use your data for anything else without telling you first and, where the law requires it, asking for your consent.
  5. 3.5There is no profiling, no advertising list and no sale of data. Your address is not reused for newsletters, because we do not send any.
5.0

Sharing and outsourcing

  1. 5.1We do not provide your data to third parties for their own use.
  2. 5.2Two kinds of service provider touch your data in the ordinary course of work: the mailbox provider that carries our email, and the courier that delivers a finished piece. They receive only what the service needs, and we remain responsible for supervising how they handle it.
  3. 5.3Fabric and trim suppliers receive material orders. They never receive your name, your measurements or your photographs.
  4. 5.4Our mailbox provider may store mail on servers outside Japan. Where that is the case we rely on providers that apply security controls comparable to those the APPI expects, and we will tell you which countries are involved if you ask.
  5. 5.5We disclose data to a court or authority only where the law requires it.
6.0

How long we keep it

  1. 6.1Enquiries that do not become a commission are deleted within twelve months of the last message.
  2. 6.2For a commission, the measurements, the pattern card and the written terms are kept while the piece is in production and while any agreed adjustment is open. After that they are deleted within twelve months, unless you ask us to keep your pattern so that a later commission can start from it.
  3. 6.3Records that Japanese accounting and tax law oblige us to keep are kept for the period the law requires and for no other purpose.
  4. 6.4When data is deleted, we remove it from the mailbox and its backups in the normal cycle, and paper pattern cards are shredded.
7.0

Your rights

  1. 7.1Under the APPI you may ask us to tell you the purposes for which we use your data, to disclose it, to correct or add to it, to delete it, to stop using it, or to stop providing it to a third party, as far as the Act gives you that right.
  2. 7.2Send the request to info@helm-toss.com and say which data you mean. So that we do not hand your data to someone else, we may ask you to write from the address you used before or to confirm a detail from your earlier message.
  3. 7.3We answer without delay. We do not charge a fee for ordinary requests.
  4. 7.4If we decline a request in whole or in part, we tell you the reason.
